Property insurance should be the most straightforward line of coverage. Right? Pay the premiums. Settle the claim after the fire. Replace the damaged home or commercial building. To the contrary, it is often one of the most complex areas in all Property and Casualty insurance.
The wide variation in types and locations of buildings, business personal property and Business Income exposures has resulted in available coverage for nearly every circumstance. Structuring coverage correctly requires expertise with a myriad of policy forms and endorsements, including those found in the Inland and Ocean Marine lines.
How does a business owner customize insurance for loss of electronic equipment & data, tenant’s improvements & betterments or bailee's exposure for property of others? Building owners have acute ordinance & law exposures. Manufacturers should analyze loss valuation regarding selling price on finished stock. Contractors utilize equipment floaters and builders risk policies. Given the catastrophic nature of hurricanes and floods it may take years for policyholders to rebuild—if they ever do. The majority of businesses with inadequate Business Income coverage never return to operation after a large fire or windstorm loss.
Homeowners face many of the same dilemmas:
What policy limit do I need to rebuild the house? Do I have enough insurance to replace my contents? How will my jewelry be valued? After a fire how will we pay rent for a temporary residence?
Claim settlement is easily complicated by disputes between insureds and carriers. Such disputes arise from many sources. For example:
- Valuation methods
- Coinsurance penalties
- Vacancy clauses
- Blanket vs. Specific policies
- Locations not scheduled
|
- Covered Property” Definitions
- Property off-premises
- Exclusions, Limitations, Endorsements
- Contractual or Lease requirements
- Mortgagee requirements
|
Mr. Daniel’s experience with property insurance encompasses:
| |
- Building and Personal Property Coverage
- Special (All Risk) v. Specified Perils
- Fire and Extended (Windstorm) Coverage
- Blanket Property Insurance
- Replacement Cost vs. Actual Cash Value
- Coinsurance Issues
